Terms & Refund Policy

1. What these terms cover
These terms apply to services provided by E-Skulpt Digital Marketing. The plan or quote you accept sits alongside them. If the two conflict, the written quote wins.
2. Scope of work
Each plan lists exactly what is included. Anything extra is quoted before we start, so there are no surprise bills. "Up to" means the maximum included in the plan.
3. Prices, GST and ad spend
All prices are in Indian Rupees and exclude 18% GST. Monthly plans are paid in advance at the start of each month. Starter kits are paid in full when ordered. Website projects are paid in three parts: 40% to start, 40% on design approval and 20% before launch.
Ad spend is separate. You pay Google, Meta or any other platform directly from your own payment method. We never hold, mark up or take a commission on ad spend. WhatsApp API message fees are passed on at cost.
4. Offers and discounts
Offer codes apply to new orders and are subject to the conditions shown on the offers page. The first-month discount is limited to one per business and cannot be combined with prepay discounts. We may change or end offers at any time, but accepted quotes are honoured.
5. Your part
We need timely access to your accounts, approvals and the information only you can give, such as photos, prices and offers. Delays on your side move the timeline but do not reduce that month's fee.
6. Ownership
You own your domains, pages, ad accounts, analytics, published content and design files. When you leave, we hand over all logins within 7 days.
7. No lock-in and cancellation
Monthly plans run month to month. Either side may cancel with 30 days' written notice, including by WhatsApp or email. Prepaid 3, 6 and 12-month terms run for the period paid.
8. 30-day happiness promise
If we don't deliver what your plan lists in your first month, and the delay isn't caused by missing input or approval from you, we will redo the work at no cost. If you are still not satisfied, we will refund our fee for that month.
9. What we don't guarantee
No agency controls Google or Meta, so we don't guarantee specific rankings, followers, leads or sales. We guarantee the work listed in your plan, honest reporting and quick replies.
10. Refunds
- Monthly plans: refunded for any month where the listed work was not delivered, as in clause 8.
- Prepaid terms: unused whole months are refunded, minus the discount you received for prepaying.
- Starter kits and websites: fully refundable before work starts. After design work begins, the amount paid is non-refundable.
- Ad spend and platform fees: money already paid to a platform can't be refunded by us.
- Approved refunds are paid within 10 working days to the original payment method.
11. Third-party platforms
Our work relies on platforms we don't control. We are not liable for their outages, policy changes or account decisions, but we will do everything reasonable to help fix them.
12. Limitation of liability
Our total liability is limited to the fees you paid us in the previous three months. We are not liable for indirect losses such as lost profits.
13. Governing law
These terms are governed by Indian law, and the courts of New Delhi have jurisdiction.
